Two newsworthy items.
First, I have the privilege of leading the 2015 Florida International University College of Law Aviation and Space Law Symposium in Miami, Florida.

Next, just as a government memo on the use of combat drones is released, the Federal Aviation Administration (“FAA”) has now released its interpretation of the special rule for model aircraft.
Long story short: In 2012, the President signed into law the FAA Modernization and Reform Act of 2012 (“FMRA”), which established, in Section 336, a “special rule for model aircraft.” The rule prohibits the FAA for producing a rule or regulation regarding a “model aircraft.” That means that the following activities fall outside the regulatory powers of the FAA:
- flying a model aircraft strictly for hobby or recreational use;
- the aircraft is operated in accordance with a community-based set of safety guidelines and within the programming of nationwide community-based organization;
- the aircraft is limited to not more than 55 pound unless otherwise certified through a design, construction, inspection, flight test, and operations safety program administered by a community-based organization;
- the aircraft is operated in a manner that does not interfere with and gives way to any manned aircraft; and
- when flown within 5 miles of an airport, the operator of the aircraft provides the airport operator and the airport air traffic control tower … with prior notice of the operation.
In its press release, the FAA claims that its guidance under the FMRA “comes after recent incidents involving the reckless use of unmanned model aircraft near airports and involving large crowds of people” — a reference, at least in part, to ongoing prosecutions involving UAV operation.
While using its guidance document to bolster its definition of aircraft — a fundamental issue in the ongoing Pirker case — the FAA also seems to re-frame the UAV debate, focusing on its authority and responsibility to eliminate careless aviation operations, whatever the definition of “aircraft” —
The law is clear that the FAA may take enforcement action against model aircraft operators who operate their aircraft in a manner that endangers the safety of the national airspace system. In the notice, the FAA explains that this enforcement authority is designed to protect users of the airspace as well as people and property on the ground.
The FAA will be working with its inspectors and model aircraft operators across the country to ensure they give standard information to the public on how to satisfy these statutory requirements and avoid endangering the safety of the nation’s airspace.
The FAA is also developing a plan to work with the law enforcement community to help them understand the FAA’s rules for unmanned aircraft systems, as well as the special statutory rules for model aircraft operators, so they can more effectively protect public safety.
The FAA also provides guidance in the way of “examples of flight that could be conducted as hobby or recreation flights and other types of flights that would not be hobby or recreation.”

Amazon beware. Says the FAA, in addition to the chart above, “If an individual offers free shipping in association with a purchase or other offer, FAA would construe the shipping to be in furtherance of a business purpose, and thus, the operation would not fall within the statutory requirement of recreation or hobby purpose.”
The absence of rules for commercial operation of unmanned aerial vehicles, together with seemingly arbitrary distinctions, is unfortunate.
